A permit from City of Newcastle is needed before clearing declared vegetation, which includes a tree 3 m or taller, or a single-trunk tree 15 cm or more in diameter measured 1.4 m above the ground. Where the job involves cut or fill excavation, a report by a consulting arborist (AQF5) is required for any tree, including one on the neighbour's land, within 3 m of the work, or within 5 m if its trunk is more than 36 cm in diameter. The 2026/2027 application fee for private tree removal is A$235 for 1 to 3 trees, plus A$35 for each additional tree, with no GST.

Height and siting still apply

A timber wall built with no council approval is exempt only up to 600 mm, at least 1 m from each boundary and at least 2 m from any other retaining wall on the site. Over that height it needs professional engineer certification or a development application.
